Kona Rani Bepari (18) Hindu adolescent College girl abducted for forceful conversion to Islam on 14.03.2015 from Patharghata - Barguna District.
Name of the Victim : Ms. kona Rani Bepari (female)
Name of the mother : Ms. Renu Rani Bepari, (female)
Name of the father : Bikash Chandra Bepari. (Male)
Age of the victim : 18 years ( Examinee of HSC)
Date of kidnapping : 14.03.2015 at about 10.30 a.m.
Name of the perpetrators : 1) Mohammad Badal Howladar son of Late Karim Howladar,
2) Mohammad Rassel son of Abdul Rab Member.
3) Mohammad Al-Ameen son of Nurul Hoque Kha and unknown 3- 5 perpetrators. All are residing at Patharghata Upazila of Barguna District.
Religion of the Victim : Hindu.
Religion of the perpetrators : Muslim.
Permanent Address of the victim : Village : Shingra Bunia, p.s. Patharghata, District- Barguna, Bangladesh.
FACT S IN BRIEF :
Father and daughter from their home were proceeding towards Lemua College riding on Motor Bike to fill up the forms for Higher Secondary School Certificate Examination of victim on 14th March,15 at about 10.30 all on a sudden other two Motor Bike riders behind the Motor Bike of Bikash Bepari intercepted Motor Bike of Bikash on the road near Jugirhula area (cow firm of Seraj Master of) 19 kilometres away from local police station, dictated Bikash to get down from the Motor vehicle but Bikash refused to get down from the Bike, but three above perpetrators created terror in the mind of Bikash and due to scuffling two perpetrators snatched away his daughter- Kona who cried for rescue from the bike and fled away; other perpetrators started to beat Bikash till he become senseless. Some witnesses came forward but in the meantime those perpetrators with bike decamped and abducted  the victim towards unknown destination. 
After getting senses Bikash went to Patharghata police station and described the ordeal and lodged F.I.R. at Patharghata police station being case No.18 dated 15.03.15 under section 7/30 of Women and Children Repression Act,2003 against three perpetrators and 3 to 4 unknown others.
ACTION TAKEN BY BDMW:
As per appeal filed by father and mother of victim I on behalf of BDMW communicated with Md.Saiful Islam-Superintendent of Police -Barguna District and Md.Shah Newaz- Officer in Charge of Patharghata police station for legal assistance and accordingly our representative from Barisal was requested to investigate the matter and for immediate reuse of the Vitim- Kona Rani . But it is unfortunate that the police was found very much negligent to apprehend the criminals to justice and f
or recovery of the victim since after 13 days of her kidnapping.


I, also talked with mother and father of the victim over his cell number 01725297370 who cried loudly and requested us to rescue t heir beloved daughter - Ms.Kona Rani from the clutches of perpetrators. 
I again requested the law enforcing agencies of Borguna Administration and urged upon them to rescue the victim girl from the possession of the kidnapers. Md. Shah Newaz- Officer in charge of Patharghata gave me to understand that due to love affairs occurrence took place and he is trying to rescue the victim, but the statements made by Md.Shah Newaz without asking the victim or arresting the perpetrators it was a love affairs ?
Recommendations:-
Bangladesh Minority Watch is very much concerned about abduction of minority Hindu College girl and we demand :
a} to rescue the victim with utmost sincerity.
b) The perpetrators should be arrested soon to put them in custody for trial in the court.
c) The officer in charge of Patharghata Police station should be asked to be more impartial in deciding the matter whether it was love or forceful conversion ?

Advocate Veerji Kolhi Exposes A Judicial Crime in Sindh High Court By: Zemira Eli Natan and Advocate Veerji Kolhi

Very good news today Advocate Veerji Kolhi has just informed IUFE that the High Court of Sindh has changed its ruling.  Anjali will remain in a shelter home where a medical board will determine her age as old enough to marry.

IUFE has just been notified by Advocate Veerji Kolhi of a Shocking ruling issued by the High Court of Sindh in Pakistan.  In case that pursuant to the Code of Law in Effect that all Child Marriages or knowledge of  or intent to engage in them are forbidden by Law.  It must be made very clear that this offence is punishable by law for 1-3 years or a fine or both depending on the extremity of the circumstances deemed by the court.  The documents below clearly describe the punishments for intent  and also for committing the act knowing that a child is of minor age.  The question  is how does the court find it acceptable to free a minor child in a ruling in one case , such as in the case of the release of Mavi Kolhi, also of minor age and make a different ruling involving the case of Anjali Kolhi when the same laws are in effect.  The documents below that Advocate Veerji Kolhi has provided to IUFE clearly show that the court itself committed a Judicial crime!  How do we come to that conclusion is a question that will be asked in this situation.  The answer can be found in the ambiguity of Article 7, sub-section 3  which states, " The court may on its own notion or an application of any person rescind or alter any order made under sub-section 1 of Article 7.  What this article is saying is that the court can effectively change an order and would not be obligated to enforce the laws that are in place according to Code of Law.  In other words, There are stipulations present that allow an injustice to go unheard and the law to remain only on the books but not enforced!  Article 6 of the Code of Law in Pakistan states that, " Notwithstanding anything contained in section 190 of the Code, no court other than the Judicial Magistrate of First Class shall take cognizance of or try any offence under this Act! This  is making it seemingly impossible for any Religious Minority in Sindh, Pakistan to receive justice even in a court of law!  However, Article twelve of the Code of Law clearly states, If any difficulty arises in giving effect that is not inconsistent with any of the provisions of this act, Government may make such order, as may appear to be necessary for the purpose of removing the difficulty."  THIS CODE IS AMBIGUOUS AS IT FAVORS THE PERPETRATORS OF CRIMES IN DIRECT VIOLATION OF THE  CHILD MARRIAGES RESTRAINT ACT 2013.  Advocate Veerji Kolhi notes that:

"  According to Article 8-  Offence to Punishable and Triable

Not Withstanding anything conmtained in the code, an offence punishable under this Act shall be cognizable, nonbailable and non compoundable. "

 Numerous Human Rights violations are being violated by violating these laws on the books in courts, even in the High Courts and not enforcing the laws set in place. The High Court of Sindh must recognize this and understand clearly that this issue is not acceptable to the Religious Minorities of Sindh or the International Community at large!  This issue will be made public and shared with International Human Rights Commissions , Civil Liberties Alliances and Human Rights organizations in order to render proper Justice for Religious Minorities that face this kind of persecution, oppression, and violations to their spiritual and physical well being.  IUFE demands justice for these crimes .  Anjali Meghwar must be freed and returned to her family safe and unharmed!  There is no Justice in this ruling of the High Court of Sindh  and it shall be made public!

Advocate Rabindra Ghosh has contacted me just this morning with alarming news.  Minorities in Bangladesh are suffering  increased abductions and forced conversions particularly of Hindus in Bangladesh.  This form of ethnic cleansing is occurring globally where Hindus reside in Muslim Countries and also in regions heavily populated by Muslims.  Advocate Rabindra Ghosh has made an appeal to spread the awareness regarding  this very dangerous situation that is causing Hindus to suffer needless humiliation, destruction of their communities and a threat to their very lives!  No one should ever be forced to convert to any religion that is not his own!  Complaints must be registered and shared with the International community for immediate action to end these atrocities at once!  Hindus have endured too much over the centuries as well as my own Jewish people.  This kind of destruction cannot be restored!  Action is required to ensure the safety of those vulnerable to such violation of the very spirit of humanity!  Advocate Rabindra Ghosh  needs every support for his very important work to protect Hindus in increasingly dangerous situations!  The people will no longer tolerate ethnic cleansing, destruction of Holy Shrines, Forced marriages and Forced conversions to Islam!  Every case will be shared with International Civil Liberties Alliances, and International Human Rights Organization, Journalists and Activists who will fight to stop this from ever happening again!  Jews and Hindus share a common history of Ethnic cleansing!  It is long overdue that these crimes against humanity stop!  IUFE DEMANDS JUSTICE FOR THE VICTIMS OF ABDUCTIONS, FORCED MARRIAGES AND FORCED CONVERSIONS TO ISLAM!  The International Community is put on Notice!  Spread the word and help stop crimes against humanity from reoccurring!  Bring tangible assistance to communities that have been routinely destroyed by Muslims who refuse to live with others in Peace!  May this be a course of action for all who are victims of racism, religious intolerance, incitement to violence and attacks on religious minorities!  Thank you to all advocates, activists, educators and journalists who willingly go to battle for the sake of Humanity!

Mr. Toma Joydhar (11 years 8 months) Minority Hindu children kidnapped on 02.12.14 from Bara Basail of Agoiljhara Upazila of Barisal District for forceful conversion to Islam. BDMW helped rescue the victim and arresting perpetrator on 13.12.14.

Date of occurrence   : 2nd of December, 2014 at about 11 a.m.
Place of occurrence:  Near Bara Basail High School at Agoiljahara Upazila of Barisal District.
Religion                     : Hindu
Name of the perpetrator: 1) Mohammad Jashim Gharami.
                                                2) Mohammad Akash gharami , all sons of Motleb Gharami.
Date of investigation: 8th to 14th December, 2014.

Facts in Brief: -


The victim Ms.Toma Joydhar, the student of Class Seven, who  happened to be within her  Bara Basail High School appearing for examination; but on 02.12.2014 at about 11 a.m. one unidentified person introduced himself as one of  the friends of  victim’s family  that her maternal uncle was waiting for her outside the school; Ms. Toma went out from the school gate for searching her relatives on good faith, but the perpetrators all on a sudden compelled her to board the motor bike and fled away with the victim from the place of occurrence within a twinkle of an eye.  Thereafter the news of kidnapping has been published in the national daily “ Jugantor” on 8th Dec,14 and other media dated 5th of December,14.

Investigation: -


As per verbal request of victim’s family I, on behalf of BDMW communicated with Md. Sajjad Hossain- Officer in Charge of Agoiljhara Police station at Barisal over cell phone who did not confirm the news of abduction as he said no person on behalf of victim family came to lodge any First information report before his police station.
I also contacted with victim’s family (Ms. Bina Joydhar (17)- Cell number -01781251784 elder sisters of victim) over phone she cried and seek our help for rescue of their minor sister from the forceful possession of Mohammad Jashim Gharami of Madaripur District.  They also helped providing me the cell number of the local UP Chairman and also requested us in writing to take appropriate measures to rescue their minor victim. I accordingly again contacted with Officer in Charge of Agoiljhara Police station, Local Chairman of the Union Parishad & requested him to take cognizance of the case and take necessary steps to arrest the perpetrator and to rescue the victim girl. O.C. promised me to recover the victim after filing the case against kidnapper.
Accordingly Md. Sajjad Hossain-Officer in Charge very shortly arrested the perpetrator and rescued the victim and took necessary steps to forward the perpetrator as well as the victim in the court of law as per law to ascertain the age of the victim girl. In the meantime necessary medical examination of the victim is going to be completed.

Action:  

Police took action against the perpetrator after accepting F.I.R. from the mother of the victim as per our request for taking necessary steps for recovery of the victim. ( Agoiljhara PS. Case No. 04/111 dated 12.12.2014 under section 7/30 Women and Children Repression Act,2003)  They arrested the perpetrator on 13.12.14from Madaripur District and rescued the victim on the same night. I, talked with Md. Akkas Ali –Sub Inspector of Police who informed that  perpetrator has been sent to jail custody and the victim has been sent for medical examination at Barisal District today (14.12.14)  

Recommendations:


Bangladesh Minority Watch demand:-

a)      That the minor victim should be handed over to the father and mother as per law.
b)      That the perpetrators should be brought to book as per law of the land
c)       That there should not be any discrimination against Minorities of Bangladesh.
d)      The minority victim should be protected from forceful conversion by using dubious mechanism swearing affidavit or other method.
e)      The Police officers responsible for tracing out the victim as per our request should be rewarded.
