Advocate Veerji Kolhi Investigates Murder of Three in Nagarparkar By Zemira Eli Natan and Advocate Veerji Kolhi

For the first time in the history of Nagarparkar a murder of the the most heinous kind has taken place.  The murder took place in Wadari Village, Nagarparkar  where three victims  were murdered  in cold blood.  An elderly couple and their son were resting in  their sleeping cots when they were brutally murdered in the middle of the night as they and other villagers were sleeping.  No one in the village was able to tell Advocate Veerji Kolhi who the perpetrator of this murder was.  There was great fear to reveal any  details.  Advocate Veerji Kolhi returned to the village many times to assist investigators and question the villages to glean any information on the killers.  The  problem with this investigation  is that after a cast  was  taken of the perpetrators footprints  no one seemed to be able to identify the killers.  Twenty  six suspects were arrested in this case  and all twenty six of them went free.  Advocate  Veerji Kolhi did not stop here.  When a team of forensic special investigators brought a dog team to locate the killer, the dogs returned to the same hut twice. The police refused to bring  the suspects living there into custody. The perpetrator was among the 26 suspects released  from police custody.  The  very dangerous  issue in this case is that the court closed the investigation.  I advised Advocate Veerji Kolhi  to ask the court to reopen the investigation.   According to the Final Report document  issued by the Superintendent of Police Tharparkar for the cancellation of FIR dated 4/20/2015   so ordered by the Nagarparkar Judicial Magistrate, the police are still responsible to continue their efforts to the best of their ability to locate and arrest the perpetrator of this horrific crime despite the fact that the investigation was closed.    Advocate Veerji Kolhi fully intends to ensure the cooperation of the police in this matter.  Two  of the victims of this horrible crime  were senior citizens age  75  Male  and  Female  age 65.  The son was  just  a teenager about 14- 16  years  of age.  This was extremely  painful  for the indigenous people of this land because they have never lived in fear that something like this could ever happen.  Despite abductions,  they felt that murder could never be an issue.  Increasing violent crimes are happening in Sindh which was once a place of relative peace for all people.  Now it has become a place where innocent people are regularly targeted just because they have different religious beliefs.  For the safety of the victims and their families Advocate Veerji  Kolhi has not released the names of the victims.  The people are very concerned that since the perpetrator is still at large, there might be a chance that a repeat crime could occur. IUFE  demands  that the perpetrator be brought  to justice  immediately  with penalty of the full extent of the law.  Such a crime  is punishible by death and this is what these villagers rightfully are demanding!  Their protest is strong  and should be heard by all human rights organizations,  the presiding court and law enforcement agencies in Sindh to render proper justice to the indigenous people of the land .  Thank  you Advocate Veerji Kolhi for your briefing on this case  and standing with you  to continue to demand justice for the villagers in Wadari Village, Nagarparkar.

What can  we say this case is all about?  Clearly  it is an effort by those wishing to threaten any resistance to control of those politicians who want to keep their stronghold in this region.  Advocate Veerji Kolhi was requested to surrender his political  and social intervention which is the sole protection of the people living in these villages.  We cannot allow  10,000 years of indigenous  people's  legacy to be destroyed under this kind of pressure.  Advocate Veerji Kolhi cannot leave his people vulnerable to being forced from their indigenous homeland  by  Zandibars and Politicians
who deny these people their right to live peacefully and safe from such violent crimes.

We as an international coalition cannot allow them  to force their hand.  We  must all stand in unity to support Advocate Veerji Kolhi in his continuous and brave efforts to protect his people from harm.  We ask that International Human Rights organizations be contacted to ensure the protection of the indigenous people of Sindh and protection for the Advocates who defend them.

Advocate Rabindra Ghosh Issues An Urgent Appeal Against The Threat of Ethnic Cleansing in Bangladesh By: Zemira Eli Natan and Advocate Rabindra Ghosh

Advocate Rabindra Ghosh  of Bangladesh Minority watch has posted numerous cases illustrating the lack of intervention conduction by the police in Bangladesh.  These cases involve serious harassment of Hindu and other minority communities .  Advocate Rabindra
Ghosh and his staff have had attempts taken on their lives as they investigate these matters thoroughly and expose the perpetrators of various crimes including rape and abduction of women, destruction and looting of  villages, and destruction of Holy shrines.  The medias are silent and there is no law enforcement available to enforce the laws that protect these communities from harm.  Below is Advocate Rabindra Ghosh direct statement concerning this very viable threat
:

"Bangladesh Minority Watch is very much concerned with the continued threat by the police department during our fact finding in different parts of Bangladesh.  We had met and spoken with the Minister for Home Affairs, Mr. H.T. Imam- Political Adviser to Prime Minister of Bangladesh. Apart from this we also informed Dr.Mizanur Rahman- Chairman-National Human Rights Commission of Bangladesh. But no remedial measures taken by them for protection of Human Rights defenders for Minority Rights.

We need urgent action against police officers responsible for threat and intimidation during fact finding in different parts of Bangladesh."

Our discussion did not conclude here.  I was able to share my experience in Kokrajhur Assam and explained how there is no police or government intervention to address the influx of Muslims entering into India and grabbing land from Hindus whenever and wherever it suits them.  Advocate Rabindra Ghosh gives the following explanation as to events currently occurring and others that are ongoing problems:


"Every day we are facing problem with police authority, perpetrators those are kidnapping Hindu girls, forcefully occupying our lands, frequent abduction of Hindu girls with rape incidents are common in Bangladesh. Police is very much negligent on this matter.

I need to do something for the protection of rights of minorities of Bangladesh as those minorities of Bangladesh is going to be ethnically cleansed.

Intervention is necessary for the protection of rights of minorities of Bangladesh. You know that since 2001 to 2015 we are being harassed by the law enforcing agencies, lawyers, law makers, MP and other perpetrators in different times, Despite all we did not leave our country Bangladesh, as we love Bangladesh well."


As you can see  these issues have been occurring in Bangladesh for fourteen years and nothing has changed.   Issues such as these are also occurring in India.  Bangladeshi Muslims are entering the country  to escape justice and avoid further trouble in Bangladesh while, at the same time, causing havoc in India.  The response of Law Enforcement is deplorable! The medias refuse to broadcast the news for fear of escalating political issues and government censorship which is now occurring in the region on a wide scale.


At this time and for all occurring incidents  our Advocates and their staff, international delegations and Minority leaders are asking for TANGIBLE assistance for these victims.  There are thousands of families devastated by these crimes against humanity.  The correct action to take is first to bring these incidents to the public and bring awareness to the International Community, second to bring these issues to the attention to the medias and continue to contact them  to encourage proper and honest media coverage of these incidents, third  to contact international human rights organizations and follow up with causes to bring tangible assistance to the victims and their families.  Writing correspondence to government officials as a group  with numerous signatures can help pressure the government and the law enforcement agencies who refuse to enforce laws that protect minorities against these crimes against humanity.  These crimes violate numerous articles of the Universal Declaration of Human Rights of the United Nations.  I have posted my report of my visit to two of five refugee camps whose victims claim are being attacked on! one side by Baptist Christian Missionaries who are armed and Muslims from Bangladesh on the other side.    These people cannot be ethnically cleansed!  The International Community cannot stand for it!  Action is the key and IUFE demands action on the part of all who take the time to read this.  Action can include sharing, contacting, and exposing.  Everyone can do their part to help.  Please take decisive action for the sake of humanity.

Advocate Veerji Kolhi Exposes A Judicial Crime in Sindh High Court By: Zemira Eli Natan and Advocate Veerji Kolhi

Very good news today Advocate Veerji Kolhi has just informed IUFE that the High Court of Sindh has changed its ruling.  Anjali will remain in a shelter home where a medical board will determine her age as old enough to marry.

IUFE has just been notified by Advocate Veerji Kolhi of a Shocking ruling issued by the High Court of Sindh in Pakistan.  In case that pursuant to the Code of Law in Effect that all Child Marriages or knowledge of  or intent to engage in them are forbidden by Law.  It must be made very clear that this offence is punishable by law for 1-3 years or a fine or both depending on the extremity of the circumstances deemed by the court.  The documents below clearly describe the punishments for intent  and also for committing the act knowing that a child is of minor age.  The question  is how does the court find it acceptable to free a minor child in a ruling in one case , such as in the case of the release of Mavi Kolhi, also of minor age and make a different ruling involving the case of Anjali Kolhi when the same laws are in effect.  The documents below that Advocate Veerji Kolhi has provided to IUFE clearly show that the court itself committed a Judicial crime!  How do we come to that conclusion is a question that will be asked in this situation.  The answer can be found in the ambiguity of Article 7, sub-section 3  which states, " The court may on its own notion or an application of any person rescind or alter any order made under sub-section 1 of Article 7.  What this article is saying is that the court can effectively change an order and would not be obligated to enforce the laws that are in place according to Code of Law.  In other words, There are stipulations present that allow an injustice to go unheard and the law to remain only on the books but not enforced!  Article 6 of the Code of Law in Pakistan states that, " Notwithstanding anything contained in section 190 of the Code, no court other than the Judicial Magistrate of First Class shall take cognizance of or try any offence under this Act! This  is making it seemingly impossible for any Religious Minority in Sindh, Pakistan to receive justice even in a court of law!  However, Article twelve of the Code of Law clearly states, If any difficulty arises in giving effect that is not inconsistent with any of the provisions of this act, Government may make such order, as may appear to be necessary for the purpose of removing the difficulty."  THIS CODE IS AMBIGUOUS AS IT FAVORS THE PERPETRATORS OF CRIMES IN DIRECT VIOLATION OF THE  CHILD MARRIAGES RESTRAINT ACT 2013.  Advocate Veerji Kolhi notes that:

"  According to Article 8-  Offence to Punishable and Triable

Not Withstanding anything conmtained in the code, an offence punishable under this Act shall be cognizable, nonbailable and non compoundable. "

 Numerous Human Rights violations are being violated by violating these laws on the books in courts, even in the High Courts and not enforcing the laws set in place. The High Court of Sindh must recognize this and understand clearly that this issue is not acceptable to the Religious Minorities of Sindh or the International Community at large!  This issue will be made public and shared with International Human Rights Commissions , Civil Liberties Alliances and Human Rights organizations in order to render proper Justice for Religious Minorities that face this kind of persecution, oppression, and violations to their spiritual and physical well being.  IUFE demands justice for these crimes .  Anjali Meghwar must be freed and returned to her family safe and unharmed!  There is no Justice in this ruling of the High Court of Sindh  and it shall be made public!

Advocate Rabindra Ghosh has contacted me just this morning with alarming news.  Minorities in Bangladesh are suffering  increased abductions and forced conversions particularly of Hindus in Bangladesh.  This form of ethnic cleansing is occurring globally where Hindus reside in Muslim Countries and also in regions heavily populated by Muslims.  Advocate Rabindra Ghosh has made an appeal to spread the awareness regarding  this very dangerous situation that is causing Hindus to suffer needless humiliation, destruction of their communities and a threat to their very lives!  No one should ever be forced to convert to any religion that is not his own!  Complaints must be registered and shared with the International community for immediate action to end these atrocities at once!  Hindus have endured too much over the centuries as well as my own Jewish people.  This kind of destruction cannot be restored!  Action is required to ensure the safety of those vulnerable to such violation of the very spirit of humanity!  Advocate Rabindra Ghosh  needs every support for his very important work to protect Hindus in increasingly dangerous situations!  The people will no longer tolerate ethnic cleansing, destruction of Holy Shrines, Forced marriages and Forced conversions to Islam!  Every case will be shared with International Civil Liberties Alliances, and International Human Rights Organization, Journalists and Activists who will fight to stop this from ever happening again!  Jews and Hindus share a common history of Ethnic cleansing!  It is long overdue that these crimes against humanity stop!  IUFE DEMANDS JUSTICE FOR THE VICTIMS OF ABDUCTIONS, FORCED MARRIAGES AND FORCED CONVERSIONS TO ISLAM!  The International Community is put on Notice!  Spread the word and help stop crimes against humanity from reoccurring!  Bring tangible assistance to communities that have been routinely destroyed by Muslims who refuse to live with others in Peace!  May this be a course of action for all who are victims of racism, religious intolerance, incitement to violence and attacks on religious minorities!  Thank you to all advocates, activists, educators and journalists who willingly go to battle for the sake of Humanity!

Place of occurrence:  Near Bara Basail High School at Agoiljahara Upazila of Barisal District.

Name of the perpetrator: 1) Mohammad Jashim Gharami.
                                                2) Mohammad Akash gharami , all sons of Motleb Gharami.
Date of investigation: 8th to 14th December, 2014.

Facts in Brief: -


The victim Ms.Toma Joydhar, the student of Class Seven, who  happened to be within her  Bara Basail High School appearing for examination; but on 02.12.2014 at about 11 a.m. one unidentified person introduced himself as one of  the friends of  victim’s family  that her maternal uncle was waiting for her outside the school; Ms. Toma went out from the school gate for searching her relatives on good faith, but the perpetrators all on a sudden compelled her to board the motor bike and fled away with the victim from the place of occurrence within a twinkle of an eye.  Thereafter the news of kidnapping has been published in the national daily “ Jugantor” on 8th Dec,14 and other media dated 5th of December,14.

Investigation: -


As per verbal request of victim’s family I, on behalf of BDMW communicated with Md. Sajjad Hossain- Officer in Charge of Agoiljhara Police station at Barisal over cell phone who did not confirm the news of abduction as he said no person on behalf of victim family came to lodge any First information report before his police station.
I also contacted with victim’s family (Ms. Bina Joydhar (17)- Cell number -01781251784 elder sisters of victim) over phone she cried and seek our help for rescue of their minor sister from the forceful possession of Mohammad Jashim Gharami of Madaripur District.  They also helped providing me the cell number of the local UP Chairman and also requested us in writing to take appropriate measures to rescue their minor victim. I accordingly again contacted with Officer in Charge of Agoiljhara Police station, Local Chairman of the Union Parishad & requested him to take cognizance of the case and take necessary steps to arrest the perpetrator and to rescue the victim girl. O.C. promised me to recover the victim after filing the case against kidnapper.
Accordingly Md. Sajjad Hossain-Officer in Charge very shortly arrested the perpetrator and rescued the victim and took necessary steps to forward the perpetrator as well as the victim in the court of law as per law to ascertain the age of the victim girl. In the meantime necessary medical examination of the victim is going to be completed.

Action:  

Police took action against the perpetrator after accepting F.I.R. from the mother of the victim as per our request for taking necessary steps for recovery of the victim. ( Agoiljhara PS. Case No. 04/111 dated 12.12.2014 under section 7/30 Women and Children Repression Act,2003)  They arrested the perpetrator on 13.12.14from Madaripur District and rescued the victim on the same night. I, talked with Md. Akkas Ali –Sub Inspector of Police who informed that  perpetrator has been sent to jail custody and the victim has been sent for medical examination at Barisal District today (14.12.14)  

Recommendations:


Bangladesh Minority Watch demand:-

a)      That the minor victim should be handed over to the father and mother as per law.
b)      That the perpetrators should be brought to book as per law of the land
c)       That there should not be any discrimination against Minorities of Bangladesh.
d)      The minority victim should be protected from forceful conversion by using dubious mechanism swearing affidavit or other method.
e)      The Police officers responsible for tracing out the victim as per our request should be rewarded.

The Unjust Detention of Kamran Simon Saif By: Zemira Eli Natan

Many of our friends within our coalition are very familiar with Kamran Simon Saif, a Pakistani Christian who has been detained at Rotterdam in the Netherlands  for not  carrying proper identification with him while crossing the border.  After he spent many months detained in the company of potentially dangerous detainees in Rotterdam, his case remained unheard at the IND.  His advocate submitted more than enough evidence  to the IND as  pertaining to his true identity.  They detained him for months even after submitting that proof!  He is now being transported from Rotterdam to Amsterdam!  This is a two hour journey from the home of Esther  Kramer his beloved friend and companion.  She works tirelessly to visit him regularly to ensure that he is in good health during his detention and to be his hope and his strength.  Her daily work  in publicizing his detention  and also her sacrifice to save him from the humiliation and danger of being deported back to Pakistan, a land where killing a religious minority  is done without remorse , especially a Christian is beyond what many who have the ability to are doing to keep him free from detention and deportation.  His case is not a difficult one.  It has been proven time and again.  Yet, the IND is still not satisfied!  An effort  was made to submit papers to members of the European Court to demand that Kamran Simon Saif be set free.  The advocate handling his case refused to return calls and refused to release his file so that a proper defense could be prepared for Kamran.  The lack of response from church leaders is shocking that this young man is not so much a concern that they could actually allow him to be deported back to a land where his entire family has a fatwa against them.  Where is the logic , the sanity , the justice and the reason behind releasing Muslims who destroy, rape, and insist on violating the rights of people in Europe while demanding their own rights?  IUFE was shocked to learn that Simon was being moved so quickly and also that his access by phone is being denied to him!  The Link below  is the location that Kamran Simon Saif is being detained:

  They are transporting him as this article is being written.  I ask the International community to make contacts with leaders who can press the IND to release Kamran into the care of Esther Kramer who is his life companion and trusted helper.  To allow him to be deported back to Pakistan would mean the end of his life for certain!  This case will be shared with Civil Liberties Alliances and Human Rights Organizations to demand Kamran Simon Saif's immediate release!  This detention is not unlike what occurred in the Holocaust where detention was common for those the Nazis termed as criminals!  To see that something like this is currently acceptable by the IND is shocking!  Especially since that history was  told to everyone as "NEVER AGAIN" .  It cannot happen ever again!  This gifted, talented young author whose poems and music that many of us cherish,  is not a candidate for detention!  It cannot be accepted that such a person is detained while Muslims who actively commit serious crimes in the Netherlands walk free!  Never can we accept it!  Nor shall we accept it! The demand  is very clear!  Release Kamran Simon Saif!  Grant him asylum in Netherlands!  He must have access to the outside world by phone and by Internet!  It cannot be accepted that he is cut off from his community who love him and cherish his friendship.

AN URGENT CRY FOR HELP HAS BEEN RECEIVED FROM THE MONKS OF BODU BALA SENA.  IT HAS BEEN REPORTED THAT BUDDHIST MONKS , THAT MANY ARE TRAPPED IN BANGLADESH WITH THE THREAT OF BEING KILLED BY MUSLIMS RISING EVERY DAY.  THE MONKS ARE ATTEMPTING TO UNITE WITH THEIR LEADERS FOR A POSSIBLE SOLUTION AS THESE MONKS ARE NOT ABLE TO COMMUNICATE WITH THE OUTSIDE WORLD WITHOUT SERIOUS RISK.  I WILL RECEIVE REPORTS  FROM A MONK FROM THIS SENA REGULARLY.  IT MUST BE SHOWN WITHOUT A SHADOW OF A DOUBT THAT THESE MONKS ARE IN SERIOUS THREAT OF THEIR LIVES.  THEY ARE ISOLATED ON CHITTAGONG MOUNTAIN IN BANGLADESH WITH NO CHANCE FOR THEM TO RETURN TO THEIR HOMES.  THEY HAVE ENDURED BEING KILLED WHILE PRAYING IN THEIR SHRINES, THEIR STATUES OF BUDDHA ARE BEING COMPLETELY DESTROYED. THIS NEWS COMES TO IUFE AT GREAT RISK TO THE MONK REPORTING IT!  ALL ACTIVISTS ARE ASKED TO REPORT THIS AND SHARE IN ORDER TO MAINTAIN THE SAFETY OF BUDDHIST MONKS UNDER CURRENT THREAT!  IUFE DEMANDS THAT THESE MONKS RECEIVE FULL PROTECTION FROM BEING THE VICTIMS OF ETHNIC CLEANSING !  THESE ISSUES WILL BE SHARED WITH HUMAN RIGHTS ORGANIZATIONS AND CIVIL LIBERTIES ALLIANCES TO ENSURE THEIR PROTECTION.
